Otherness in Moby Dick - Essay Example The capacity to reveal human nature within fiction is especially true when demonstrating various ways of life, or aspects of social culture. Quality fiction, regardless of when it was written or the length of the written text, can reveal significant aspects of human nature and thus reveal us to ourselves as we identify various elements of the story with our everyday lives. Literature such as Melville's novel Moby Dick or The Whale remind us that even when we feel we belong within a society, there are often elements of otherness that keep us separate. One of the first examples of Otherness found within the book is Ishmael's enforced relationship with Queequeg. Otherness is established when Ishmael checks into a very crowded whalers' inn, the Spouter Inn, at which the only accommodation to be had is a shared bed with a harpooneer. Although he agrees to the necessity easily enough, Ishmael begins to have strong misgivings about the idea as the night draws forward and he has yet to meet the man, "the more I pondered over this harpooneer, the more I abominated the thought of sleeping with him" (18). His feelings are not eased by hearing the strange stories that are told of this man selling heads that he picked up in New Zealand. Given the opportunity to look around the room before Queequag's arrival, Ishmael is also surprised by the strange things the harpooneer has in his possession such as "a parcel of outlandish bone fish hooks on the shelf over the fire-place" (22) and a strange object draped over a chest. Queequag's appearance does nothing to help him blend in either, described as "a dark, purplish, yellow color, here and there stuck over with large blackish looking squares" (23), which gives Ishmael cause for brief alarm. This alarm is only heightened by Queequag's strange bedtime ritual with the idol. Like many individuals, Ishmael's first reaction to Otherness is not an attempt to understand as much as it is an instinct to fear and flee. In spite of his misg ivings regarding the Otherness of his mysterious roommate, though, Ishmael is willing to work through them to discover more. This becomes clear as he tries on Queequag's poncho, which Ishmael describes as a doormat with a hole or slit in the middle, "I put it on, to try it, and it weighed me down like a hamper, being uncomfortably shaggy and thick" (22). This willingness to try on the unknown persona of another is what enables Ishmael to overcome his original aversion to the man himself once he finally appears. Because of this earlier willingness to think through the strangeness, Ishmael is quickly able to overcome his initial reaction to Queequag's appearance, "what is it, thought I, after all! It's only his outside; a man can be honest in any sort of skin" (23). Although he has numerous misgivings at first, Ishmael is able to recognize that Queequag's manner is gentle and kind. "For all his tatooings he was on the whole a clean, comely-looking cannibal" (26). Not only that, but Is hmael realizes Queequag is as much human as Ishmael himself and thus susceptible to all the same fears and misgivings Ishmael himself has been experiencing. Britishness tests Essay A) One reason why David Blunkett wants to introduce the Britishness Tests is because he feels that understanding the UKs way of life will help immigrants to take part in the British society. Assimilation is increasing as the ethnic minorities are adopting the mainstream culture of the British society. This may show that as immigrants enter the country they adopt to the culture to feel part of the society. This may also increase the immigrants sense of values that we hold within Britain if a Britishness Test is introduced. A second reason why David Blunkett wants to introduce this test is that he wants to see a greater pride from British people about their own culture and identity. British pride is shown through the symbols and rituals that are followed. The symbols include flags, anthems and monuments this show Britishness as they are present in many places and are valued by many of the British members. Rituals such as the Queens speech as also valued by many people as they are proud of their country. Schusden talks about how people celebrate their nationality through symbols and rituals and unite us in Britishness. This shows that these types of values could show how Britishness is measured. B) One criticism of the Britishness Tests is that Globalisation is increasing. The boundaries are blurring in nations. This means that there are more varieties within the people living in the UK. Therefore Britishness does not fit extremely well as the variations go away from Britishness and focus more on the Globalisation of the country. Waters states that Celtic identities within Britain separate the British Identity as there are many people that say they are Scottish, welsh etc. this shows that people have different identities within Britain and that people see themselves in a global culture. A second criticism of the Britishness Tests is multiculturalism. As we live in a society where there is the co existence of two or more distinctive ethnic groups we are more exceptive of other norms, values and ways of life. Ethnic minority cultures and identities are slowly changing. This may represent a normal development of the culture rather than a step towards assimilation. Nevertheless, the divisions between cultures seem to be getting more blurred. Britishness cannot be measured when there are many different ethnic groups living together because they are sharing their views and beliefs on culture. C) One agent of secondary socialisation that creates ethnic identities is peer groups. Johals concept of the white mask focused on second and third generation British Asians. He found that they have a dual identity in that they inherit an Asian identity and adopt a British one. This results in Asian youth adopting a white mask in order to interact with white peers at school or college, but emphasising their cultural difference whenever they feel it is necessary. This shows that peers can have a huge impact on creating an ethnic identity. Tony Sewell suggests that young African-Caribbeans are overly influenced by commercial popular culture and its emphasis on designer labels and logos in constructing a personal identity and ethnicity.

Big Bang Theory Fifteen billion years ago, give or take five billion years, the entirety of our universe was compressed into the confines of an atomic nucleus. Known as a singularity, this is the moment before creation when space and time did not exist. According to the prevailing cosmological models that explain our universe, an ineffable explosion, trillions of degrees in temperature on any measurement scale, that was infinitely dense, created not on fundamental subatomic particles and thus matter and energy but space and time itself. Cosmology theorists combined with the observations of their astronomy colleagues have been able to reconstruct the primordial chronology of events known as the big bang. Quantum theory suggests that moments after the explosion at 10 -20 second, the four forces of nature; strong nuclear, weak nuclear, electromagnetic and gravity were combined as a single "super force" (Wald). Elementary particles known as quarks begin to bond in trios, forming photons, positrons and neutrinos and were created along with their antiparticles. There are minuscule amounts of protons and neutrons at this stage; approximately 1 for every one billion photons, neutrinos or electrons (Maffei). The density of the Universe in its first moment of life is thought to have been 1094g/cm3 with the majority of this being radiation. For each billion pairs of these heavy particles (hardens) that were created, one was spared annihilation due to particle-antiparticle collisions. The remaining particles constitute the majority of our universe today (Novikov). During this creation and annihilation of particles the universe was undergoing a rate of expansion many times the speed of light. Known as the inflationary epoch, the universe in less than one thousandth of a second doubled in size at least one hundred times, from an atomic nucleus to 1035 meters in width. An isotropic inflation of our Universe ends at 10-35 second that was almost perfectly smooth. If it were not for a slight fluctuation in the density distribution of matter, theorists contend, galaxies would have been unable to form (Parker). The universe at this point was ionized plasma where matter and radiation were inseparable. Additionally there were equal amounts of particles and antiparticles. The ratio of neutrons and protons albeit small is equal. When the universe aged to one hundredth of a second old neutrons begin to decay on a massive scale. This allows for free electrons and protons to combine with other particles. Eventually the remaining neutrons combine with protons to form heavy hydrogen (deuterium).

Changes in Death Management Practices One of the first noted changes in the book regarding attitudes towards death can be seen with the advances in mass media. As Technology has advanced, so have the ways in which news is reported to the world. Radio, Television, and the Internet have given the public many ways of receiving information. When situations portray a perceived threat, people turn to mass media for information. The ability to access information regarding worldwide disasters, terrorism, and other acts of brutality make us feel like survivors of death. Because we are able to see and hear about things that we have no firsthand knowledge of, we feel like we are experiencing it to some degree. (DeSpelder, Strickland pg. 6) During the Vietnam War, television gave people access to images of things that were happening half a world away. In no other time were daily doses of violence to this degree a part of everyday life. Media analyst George Gerbner observed that these depictions of death evoked a heightened sense of danger, insecurity, and mistrust which contributed to an â€Å"irrational dread of dying and thus to diminished vitality and self-direction in life† (DeSpelder, Strickland pg. 8) Life expectancy and Mortality Rates have been affected by technology as well. In 1900, the average life expectancy was 47 years of age in the United States. As of 2005, the average life expectancy rose to 78 years of age. This rise can be attributed to epidemiologic transition which moves the largest number of deaths from the young to the old. In the early days people died from infection due to lack of medication and knowledge on how to treat and prevent. As this knowledge was gained, deaths tended to be from chronic disease processes that are common in the older population rather than young. In 1900, over half of deaths that occurred were to children under the age of 14. That number has decreased to less than 2% and this fact influences how we feel and think about death. (DeSpelder, Strickland pg. 36) In the 1870’s, nine out of ten Americans over the age of 15 had lost a parent or a sibling. Because medicine and medical care was not advanced, mother’s died during child birth and/or babies were born still born due to lack of prenatal knowledge and care advancement. The family unit was very important and often people in this time period would display postmortem pictures of loved ones who had passed as a testament to this family unit and the common knowledge of their mortality. One other change that has taken place is death rituals. In the early 1900’s families were more likely to be multigenerational living in the same house. People tended to intermingle with other generations out of necessity. Families lived on large homesteads and it took everyone to make it work. Because of this, multiple generations were present at the death of older family members and rituals and traditions existed. In this day and age people are more mobile and on the move. It is harder to maintain close relationships with family when you don’t live in the same state, let alone city. People appear to be less affected by the death of an older relative when the closeness of the relationship has been lost due to sheer proximity. Several changes that can be discussed regarding children are their attitudes towards death, their functional ability to understand death, and their desensitization to violence regarding death. Children’s attitudes towards death are much different in this day and age from in the late 1800’s or early 1900’s. In that time, families tended to live together in extended family situations possibly on homesteads. There was less access to medical care and things were taken care of at home. Death was something that was seen as a natural part of the living process and happened more regularly because of the generations that cohabitated. In this day and age as generations tend to live separately, children are more sheltered from this and therefore tend to look at death as something that doesn’t directly affect them. Jean Piaget, a theorist in human development, did extensive study of children and divided them into approximate age groups and developmental periods. He theorized that we develop our knowledge based on things we already know. These stages are sensorimotor from birth to 2 years when children learn based on their senses and motor abilities and begin to develop the idea of object permanence where they understand an object is still present even when it can’t be seen. Preoperational from 2-7 years where they progress from egocentric thought where they look at things as if they are the center of the world to prelogical where they learn trial and error and can begin to understand other points of view. Concrete operational from 7-12 years where they are able to logically understand and organize information and begin to think forward and backward about experiences. And finally, Formal operational from 12 years and up where they can think hypothetically and abstractly about situations and begin to have an interest in ethical situations. . (DeSpelder, Strickland pg. 2-53) Before these types of theorists existed, death was considered a natural part of the living experience and children just dealt with it like the rest of the family. Also in early years when children talked about death, it tended to be in the context of disease processes and accidents. As the culture has, advanced children are routinely exposed to things they weren’t before. If you ask, a child now days what things are that can cause death you may hear things like gunshot wounds and other traumatic experiences that can be linked to crime, violence they see on TV or video games or inner city experiences. In a cultural or historical sense differences in how dying is perceived can be from a cultural standpoint. Different religious and ethnical cultures have different practices and beliefs regarding death but as we have become more culturally competent society, the varying beliefs have become better understood. The physical cause of dying has changed simply by historical differences in living conditions. For example, in the Stone Age people were more likely to have died from trauma and animal attacks, whereas today dying from frailty, organ failure and dementia are more common. One change in regards to mortality and society where death is concerned can be related to education and training. For example, an earthquake in Japan in 1923 caused the death of 100,000 people. Today, because of advances in technology and safety we have ways to warn people of dangerous weather situations and have developed better safety practices that if followed can save many lives. . (DeSpelder, Strickland pg. 135-136) Change has also been seen in the conventional signs of death. Most deaths are determined by the absence of heartbeat and breathing. With the advances in technology and medicine, though, it is possible for mechanical ventilation and medications to artificially maintain these functions while the brain is termed dead. For this reason, the concept of brain death was created. Another innovation that has changed death is organ transplantation. Before this was discovered and perfected people had no choice but to die if they fell victim to an irreversible organ failure. Now, through organ donation and transplantation people can live long and productive lives if they can receive these lifesaving procedures. The final three changes that will be discussed are in regards to patients, staff, and institutions in the field of Health care. In 1900, about 80% of deaths in the United States took place in the home. As the invention of hospitals and other institutions took place, this shifted to the institutional setting with more people dying in hospital or nursing home setting. There is beginning to be a shift again however as hospice care becomes an option available to more and more people that allow them to stay in their homes around familiar surroundings instead of the sterile, non-personal setting of a hospital or institution. Another change that has taken place with regards to dying could be the rationing of resources. This will undoubtedly be getting even worse under Obamacare. Physicians used to be considered the gate keepers of what services and treatments were reasonably appropriate to which patients. As managed care comes more and more into the picture, this will change. Physicians will be paid a certain amount of money per month by insurance companies to manage the patients’ health. The less procedures, tests, and resources that are used the more money the physician will get to keep. This leads to the fear that rationing of resources or withholding of resources is a real possibility in order to keep from bankrupting doctors and clinics. Finally, palliative care, and end of life decisions are changing as well. There have been many advances with the advent of hospice and what can be done to allow a natural and peaceful death for those that are not interested in prolonging it. Undoubtedly, we will all die one day. There has been a shift in recent years from death being an almost taboo topic to one where people are taking control of their decisions. This is an area I am passionate about. You can take control of your end of life decisions by an advanced directive and informing your family members of your wishes. There are people who know they want every intervention possible done to keep them alive and there are those that are accepting of their own mortality, comfortable with their idea of what happens after death, and know that they want nothing heroic done to try and keep them on this earth if they cannot be an active participant.

It can be developed through supportive national policy by government, corporate tailor-made strategies by companies, and continuous self-improvement by individuals. In Western countries, the company seeks for employees who have a good communication skill, leadership, capabilities and creativity. On the other hand, Thailand focuses more on being knowledgeable. The companies start to make their own strategy to attract human capital. For example, CP creates its own university to train its potential employees. By doing so, CP can offer specialized training and also detect talented people that they are looking for. 3. Change Management There are two types of changes which are reactive change and proactive change. Reactive change is a change when something has already happened while proactive change is doing something before it happens. A company needs to have change management programs to prepare employees for uncertainty and make sure that they can adapt to various situations. However, the effort to change can fail for many reasons. If the companies do not wish to encounter failure, they should maintain proactive change. Crowdsourcing is the process whereby a company amateurs to design or create their products instead of full-time employees. It can help in terms of reducing cost. 2.5 Technology There are two types of technology which have impact on HRM which are Human Resources Information System (HRIS) and Electronic Human Resource Management (E-HRM). HRIS is the technology that introduces and provides data to the company. Examples would be MUIC OASIS and Googledoc. E-HRM is a process of transferring the information that is used for HRM. In other words, it is a tool that uses to access the system such as iPhone and iPad. These two types of technology are helpful for HR functions such as learning, recruiting and training. More people would prefer to be a freelance (do not get regular and secure jobs but irregular and insecure jobs such as part time jobs in 7-11 or fast food store). 4. Conclusion With background of human resource management, a company could understand more about the evolution of this science, learn from the history, and choose a method that suits to its style. To success in managing people, we have to concern about both competitive challenges and employee concerns. These two things will be used to consider and applied to HR functions which are planning, recruitment, staffing, job design, training, appraisal, communications, compensation, benefits, and labor relations. If a company can adapt and adjust its HR processes properly, it will be surely successful. There is no business, if there is no people to work for it.

If youve ever tried to assemble something that you purchased in pieces, such as a bookcase or other piece of furniture, you can appreciate the truthfulness of that statement. Even if the directions are in Japanese, seeing a picture or simple drawing can make the necessary steps clear (or at least clearer). In the same way, pictures make a valuable addition to practically any form of writing. However, in many cases, pictures are just not an option. At these times youll have to rely on another resource, your skill as a writer. Can you paint a picture with your words? Can you make your reader feel the blizzard? Smell the freshly baked bread? Or see the sunlight sparkling on the icy gurgling water of a mountain stream? In your non-fiction writing, can you help your audience understand and appreciate the significance of the point you are trying to convey? Word illustrations are an important tool to help you accomplish these goals.Illustrations are figures of speech, real-life experiences, or stories that help your reader visualize what you are trying to say. They not only make your writing more interesting, but they can also aid in retention and understanding. As you might guess, the word simile comes from the same Latin word as similar, a word that means like. When you use a simile you are saying that one thing is like another, or as another (see the two similes at the beginning of the paragraph). Most of us use similes all the ti me in ordinary conversation, perhaps without even thinking about it. If youve ever said that someone was as big as a house, as fat as a pig, or as dumb as a stump, youre not very nice. But congratulations! You know how to use similes.Metaphors are similar to similes, but metaphors make a stronger comparison. Instead of saying that one thing is like another, a metaphor says that they are the same. When Shakespeare said that all the worlds a stage and all the men and women merely players (As You Like It Act 2 Scene VII), he was using a powerful metaphor. You too can use metaphors to give a powerful impression or make a strong point, perhaps changing a good simile into a better metaphor. For example, you might say that someone is as courageous as a lion. This is using a simile to pay them a nice compliment. You could make it a nicer compliment by saying that the person has the heart of a lion.However, with both similes and metaphors, you have to be careful that your readers dont get th e wrong meaning. For example, if you state the above metaphor in a different way, the meaning changes. If you just say that the person is a lion, are you still paying them a compliment? Therefore, the subjunctive can often be learned best by studying examples of its use. What Is the Subjunctive Mood? Lets start with the basics: First of all, the mood (sometimes called the mode) of the verb expresses either the speakers attitude toward the verb or describes how it is used in a sentence. The most common mood, the indicative mood, is used to refer to what is real, to state facts, to make declarations. For example, the verb in Leo el libro (I am reading the book) is in the indicative mood. In contrast, the subjunctive mood is typically used in such a way that the verbs meaning relates to how the speaker feels about it. In the sentence Espero que està © feliz (I hope that she is happy), the second verb (està © or is) may or may not be reality; what is important here is the speakers attitude toward the second  half of the sentence. Examples of the Subjunctive Mood How the subjunctive is used can best be seen through examples of various uses. In these sample sentences, the Spanish verbs are all in the subjunctive mood, although the English verbs may not be: Quiero que no tengas frà ­o. (I want you to not be cold. Daisy reacts to these situations with a fearless and courageous approach. Her actions seem to affect every character in the story and are misperceived by many. Daisy consistently had the courage to stand up to the other Americans, the characters who adapted to the European culture, even though they continued to pressure her, and prevailed by not conforming to European society. Daisy is a hero in this story because of the way she approached and handled situations. A major conflict in the story is the clash of American culture and European culture. Daisy is constantly thrown into situations where she is pressured to conform to some traditional European way of doing things. Daisy does not let this pressure get to her. She instead continues to act without fear of what might happen to her. The text shows many examples of this. A major cultural conflict that happened in the novel is when Daisy is walking around the Pinchio with Mr. Winterbourne and Mr. Giovanelli. Mrs. Walker comes up in her carriage and begs Daisy to get in because of what her reputation might become since she was walking around with two men ( ). After Daisy refuses, Mrs. Walker says â€Å"should you prefer being thought a very reckless girls? and even gets Mr Winterbourne involved by having him give his opinion which lined up with Mrs. Walker’s( ). After examining the text, the reader sees that Daisy responds with a very fearless and courageous way, which in a way can also be compared to a quote from Emerson’s Self Reliance, â€Å"to be great, is to be misunderstood. † â€Å"â€Å"If this is improper, Mrs Walker,† she persued, â€Å"then I am all improper, and you must give me up†Ã¢â‚¬  is a quote that beautifully illustrates Daisy’s heroic personally by not being intimidated from the pressures of society. Another conflict in the novel was that at certain places at certain times, the chances of getting malaria were very high. While many of the locals decided to stay away from these areas, Daisy chose to not live fear. This fearlessness that Daisy displayed, led to Mr. Winterbourne confronting her and Mr. Giovanelli at the coliseum late at night about her catching the Roman fever (). Giovanelli responded to Winterbourne by saying he informed Daisy it was a â€Å"grave indiscretion† which Daisy responded with prudence (). Even now that Daisy was severely warned about the disease she still showed no fear and showed how she could be an inspiration to other women by saying she had a lovely time seeing the coliseum by moonlight and if she felt any danger she would take some pills (). â€Å"I don’t care,† said Daisy in a little strange tone, â€Å"whether I have Roman fever or not† shows how Daisy would not let fear dictate her life( ). Daisy Miller was a hero because of the fearless qualities that she displayed in the novel Daisy Miller. She may not display the common stereotypes of other fictionalized heroes such as flying or x-ray vision, but she does have influence on people, especially women, on how they can act regardless of what culture they are from. This view on life is very important because it shows young women, that they are empowered to handle situations anyway they like. Even when she died, many people showed up to her funeral and admired her. Giovanelli even stated at her funeral that out of all the women she was the â€Å"most innocent † ( ).

The concept of trafficking in people refers to the criminal practice of exploitation of human beings whereby humans are treated as commodities for profit, subjected to various forms of exploitation. Sex trafficking is a type of human trafficking The definition contains three main elements that constitute trafficking:  [1]   1.Acts- recruitment, transportation, transfer, harbouring or receipt of a person. 2.Means Threat/use of force ,other forms of coercion, abduction, fraud, deception or abuse of power or of a position of vulnerability. 3. Purpose- Prostitution, forced labour or services, slavery , slavery like practices: servitude, organ trade. Trafficking involves the following: Movement of a person, with deception or coercion and into a situation of forced labour, prostitution slavery like practices: servitude. Trafficking can occur with or without crossing any international border. Prostitution is the sale of sexual services for money. prostitution the word itself speaks about the plight of the women. it is not a problem which exists in India but exists throughout the world. The Prostitution continued from ancient and medieval India and has taken a more gigantic outlook in modern India. India is one of the biggest market for prostitution in Asia with Mumbai alone Accommodating 200,000 prostitutes. The 1990s also witnessed a significant shift in the perception of flesh trade, by differentiating prostitution from trafficking, seeing it not merely as a moral or law enforcement problem, but as a human rights(including legal and democratic rights).violation linked to gender discriminate and disparity in development. Difference between trafficking and prostitution- often, trafficking is confused with prostitution. These are not synonymous. Trafficking is the process/ means while prostitution can be the result/end (of being trafficked). Trafficking is therefore the overall process while prostitution is the result. Human trafficking is the acquisition of people by improper means such as force, fraud or deception, with the aim of exploiting them.  [2]  Human trafficking has a history coterminous with that of society and has existed in various forms in almost all civilisations and cultures. It is a trade that exploits the vulnerability of human beings, especially women and children, in complete violation of their human rights, and makes them objects of financial transactions through the use of force and duress, whether for the purpose of sex, labour, slavery, or servitude. The concept of trafficking denotes a trade in something that should not be traded in. Human trafficking as defined by the UN is, the recruitment, transportation, transfer, harboring or receipt of persons by means of the threat or use of force or other forms of coercion, of abduction, of fraud, of deception, of the abuse of power or of a position of vulnerability or of the giving or receiving of payments or benefits to achieve the consent of a person having control over another person, for the purpose of exploitation. Exploitation shall include, at a minimum, the exploitation of the prostitution of others or other forms of sexual exploitation, forced labour or service, slavery or practices similar to slavery, servitude or the removal of organs.  [3]   Human trafficking includes sexual exploitation, labour trafficking, etc. Nowadays even cross-border human trafficking is prevalent. India has a huge population and because of that and our dwindling economy many people live below the poverty line. The smugglers and traffickers promise them a better life- a ray of hope, jobs as domestic servants, in the film world or in factories. They can offer them money, pleasure trip invitations or false promises of marriage. The main targets are the poor, helpless people are the ones who are exploited the most. Social and religious practices too have been a big cause. The recruiters are the first in the chain -procurer- they may be parents, neighbours, relatives or lovers or people who have been trafficked before. The procurers move to the potential sites for victims which mostly are the poverty-stricken areas where there has been no proper rehabilitation and then they haunt the bus stops, railway stations, streets, etc. The period they choose for trafficking depends on if that place has suffered a drought or social or political disasters recently, so that it would be easier to lure in the already suffering victims. The procurers use drugs, abduction, kidnapping, persuasion or deception to bag the targets. They hand the victims to the brothel owners, escort services, or managers of a sex establishment. Sex Trafficking: The Concept Women and children from developing countries, and from vulnerable parts of society in developed countries, are lured by promises of decent employment into leaving their homes and travelling to what they consider will be a better life. Victims are often provided with false travel documents and an organized network is used to transport them to the destination country, where they find themselves forced into sexual slavery and held in inhumane conditions and constant fear. In India, public debate on the issue of trafficking of women and children for commercial sexual exploitation emerged in the 1990s.  [4]  Trafficking of Human being is one of the gravest and worst forms of violation of the basic human rights. Besides the physical trauma mental injuries that the victim suffers in the process are often unbearable. Victims lead a life of complete despair with no hope to emerge out of their pathetic conditions and in this state of neglect lead their lives in completely inhumane conditions. The traffickers deprive the victims of their most basic human rights. Victims of sexual abuse are subjected to physical violence and sexual abuse, and are held under duress against their will. They receive low or no wages. Hence, they have little or no savings. This combined with indebtedness to the trafficker keeps them in a situation of debt bondage and slavery. What gives impetus and fuels this business of flesh trade is a situation where a victim of sex traffick ing is sold against her wishes to a brothel by her procurer and the money that the procurer gets in return for her is a debt which the victim is compelled to pay in order to earn her freedom. What adds on to this problem is that a victim is often uneducated and unaware of the debt on her and continues to work for years to come in the flesh market under the belief that one day she would earn her freedom by repaying this entire amount. The victims are forced to work in extremely harsh and inhumane conditions, in extremely long working hours with little or no time for rest and also in a state of total physical confinement and bondage similar to imprisonment and have little or no control over their own movement. They are subjected to poor living conditions with abysmal hygiene and sanitation facilities.  [5]  Their extremely pitiable state is intensified when a victim contracts various diseases, unwanted pregnancies, physical injuries etc. They are on a high risk of STD, AIDS, HIV, hepatitis, tuberculosis etc. Victims have no recourse to even the basic medical needs and facilities. Social stigma and ostracism is the other problem the victims of sex trafficking made to undergo. There is no acceptance for a victim in the society during her stay and even after it if someone tries and emerges out of the clutches of a trafficker. Victims of trafficking are not accepted even by their family members thereby leaving them with no hope to even to them emerge out of it as the prospects of social rehabilitation and acceptance into the society seem not quiet alluring to a victim. They are exposed to drugs and other addictions, and sometimes forcibly made addicts in order to ensure their continued dependence on the trafficker. Once the victim falls into a traffickers clutches, she will be exploited without any hope of redresal as long as she is capable of earning. After she becomes old or ill, or is infected with HIV/AIDS, the trafficker abandons her. He no longer arranges for her bail or pays the fine for her pleading guilty, and she is left alone to face trial and the due process of Law. Trafficking is an offence and the trafficker is liable to punishment, irrespective of the consent of the trafficked person. Other than the fact of being trafficked, the traffickers deprive the victims of their most basic human rights in the following manner  [6]   à ¢Ã¢â€š ¬Ã‚ ¢ They are subjected to physical violence and sexual abuse, and are held under duress against their will. à ¢Ã¢â€š ¬Ã‚ ¢ They receive low or no wages. Hence, they have little or no savings. This combined with indebtedness to the trafficker keeps them in a situation of debt bondage and slavery.  [7]   à ¢Ã¢â€š ¬Ã‚ ¢ They are forced to work extremely long hours in inhuman working conditions leaving little time for rest. à ¢Ã¢â€š ¬Ã‚ ¢ They live in conditions of physical confinement similar to imprisonment and have little or no control over their own movement. à ¢Ã¢â€š ¬Ã‚ ¢ They are subjected to poor living conditions with abysmal hygiene and sanitation facilities. à ¢Ã¢â€š ¬Ã‚ ¢ The trafficker restricts their access to health or medical facilities. à ¢Ã¢â€š ¬Ã‚ ¢ They face social stigma and social ostracism in their daily lives and as a result undergo constant humiliation. à ¢Ã¢â€š ¬Ã‚ ¢ They are exposed to drugs and other addictions, and sometimes forcibly made addicts in order to ensure their continued dependence on the trafficker. à ¢Ã¢â€š ¬Ã‚ ¢ They face a continuous assault on their physical, psychological, and emotional health. à ¢Ã¢â€š ¬Ã‚ ¢ They face health risks such as physical injury, STD, HIV/AIDS, unwanted pregnancies, repeated abortions, gynaecological diseases, tuberculosis, and other disease. à ¢Ã¢â€š ¬Ã‚ ¢ They also face harassment from the police and prosecution, and convicted by the judicial system under the ITPA. à ¢Ã¢â€š ¬Ã‚ ¢ When they are no longer in a position to earn, they are abandoned and even the families who lived off their earnings do not support them à ¢Ã¢â€š ¬Ã‚ ¢ Children of women in prostitution, especially daughters, are prone to being trafficked themselves. They have no access to education and basic needs of life 1.1 Reasons for Trafficking Trafficking occurs not only for prostitution/commercial sexual exploitation. Women and children are trafficked for several other purposes, some of include: à ¢Ã¢â€š ¬Ã‚ ¢ Forced labour, including bonded child labour, in the carpet, garment, and other industries/factories/worksites.  [8]   à ¢Ã¢â€š ¬Ã‚ ¢ Forced or bonded domestic work may be bought and sold or forced to work in inhuman and violent conditions that include sexual abuse.  [9]   à ¢Ã¢â€š ¬Ã‚ ¢ Forced labour in construction sites with little or no wages.  [10]   à ¢Ã¢â€š ¬Ã‚ ¢ Forced employment in the entertainment industry, including bars, massage parlours, and similar establishments. In addition to poor or no pay and bad living conditions, sexual harassment is common. à ¢Ã¢â€š ¬Ã‚ ¢ Children are sometimes trafficked for begging. à ¢Ã¢â€š ¬Ã‚ ¢ Organ trade such as sale of kidneys.  [11]   à ¢Ã¢â€š ¬Ã‚ ¢ Fraudulent or forced marriage: this includes sham, fraudulent, and illegal marriages, entered into by the man, residing in India or abroad, with the criminal intention of sexually exploiting the woman. Mail order brides where women are purchased or lured with false promises of a marriage abroad and subsequently recruited into prostitution is also a form of trafficking. à ¢Ã¢â€š ¬Ã‚ ¢ Camel jockeying often involves the sale of young children who are tied on a camels back for racing. Children are often badly hurt or killed in such races. à ¢Ã¢â€š ¬Ã‚ ¢ Purchase and sale of babies for adoption, both within the country and abroad, against established laws and procedures for adoption. 1.2 Causes There are several factors that lead to trafficking of women and children or cause them to become victims of trafficking. These factors can be broadly classified into two categories: supply factors and demand factors Supply Factors à ¢Ã¢â€š ¬Ã‚ ¢ Abject poverty sometimes forces parents to sell their children to traffickers. à ¢Ã¢â€š ¬Ã‚ ¢ Harmful cultural practices often make women and children extremely vulnerable. Child marriage is sometimes the route for a child to be trafficked for sexual purposes. The stigma attached to single, widowed, and abandoned women, or second wives through bigamous marriages, causes such women to be abandoned by society. They become easy targets for traffickers. à ¢Ã¢â€š ¬Ã‚ ¢ Female illiteracy and lack of access to education by girls. à ¢Ã¢â€š ¬Ã‚ ¢ Male unemployment and loss of family income puts pressure on women to earn and support the family. à ¢Ã¢â€š ¬Ã‚ ¢ Natural calamities and poor rehabilitation of disaster victims puts pressure on women to earn and support the family. à ¢Ã¢â€š ¬Ã‚ ¢ Dysfunctional families or families that have difficulty functioning and communicating in emotionally healthy ways; a family that has a negative environment, which contributes little to the personal development and growth of family members.  [12]   à ¢Ã¢â€š ¬Ã‚ ¢ Desertion by one or the other parent, uncared for or abandoned children. à ¢Ã¢â€š ¬Ã‚ ¢ Traditional practices give social legitimacy to trafficking. These include the Devadasi and Jogin traditions where Devadasis are often trafficked and sexually exploited. This is equally applicable to other communities such as the Nats, Kanjars, and Bedias where traditionally girls are made to earn through prostitution. à ¢Ã¢â€š ¬Ã‚ ¢ Porous borders. Weak law enforcement and inefficient and corrupt policing of the borders ensure that women from neighbouring countries are brought into India and forced into prostitution in different towns. à ¢Ã¢â€š ¬Ã‚ ¢ Clandestine nature of the crime and weak law enforcement. The crime does not come to light very often because of its clandestine nature. Victims are unable to access justice and even when they attempt to do so, weak law enforcement enables the traffickers to escape. à ¢Ã¢â€š ¬Ã‚ ¢ Urban opportunities. Many women are either lured by false promises of jobs in urban areas or they voluntarily migrate to urban areas on hearing about the opportunities in cities from their neighbours and friends. When a woman is pushed into prostitution due to these causes, the issue of consent of the trafficked person is not relevant. Even if a woman knows that she is being trafficked and gives her full consent, it does not absolve the trafficker of guilt. Trafficking is an offence irrespective of the womans consent (Sections 5 and 6 of the Immoral Traffic(Prevention) Act, 1956). Demand Factors à ¢Ã¢â€š ¬Ã‚ ¢ Rising male migration to urban areas and demand for commercial sex. à ¢Ã¢â€š ¬Ã‚ ¢ Growth of tourism, which sometimes indirectly encourages sex tourism. à ¢Ã¢â€š ¬Ã‚ ¢ Scare of HIV/AIDS and prevalent myths on sexuality and STDs (Sexually Transmitted Diseases) leads to greater demand for newer and younger girls. The number of trafficked girls thus increases and their age decreases. 1.3 Concerns on Trafficking in India In the constitution of India Trafficking is prohibited.  [13]  Yet India is the Destination, source and transit for human trafficking primarily for commercial sexual exploitation, forced labour and with the falling sex ratio trafficking for marriages has become another factor for trafficking women and young girls. Trafficking of persons across the borders of Punjab and Bangladesh is not a cumbersome process, also Indias Policy of an open border with Nepal has made it difficult to identify trafficking.  [14]   There are a number of factors which are responsible for influencing trafficking of women and young girls in India. Women and young girls may be trafficked in India due to cultural practices and also because of poverty. Cultural Practices include the Devdasi System which is still prevalent in some parts of India as shown in a 2004 report by the National Human Rights Commission of the Government of India.  [15]  There are again many women who willingly migrate to the middle East, Europe and the United States to work as domestic labor who are defrauded by the placement agencies and sometimes trafficked. Women and Children trafficked within India are kept in conditions of involuntary servitude with characteristics such as withholding payment of wages, confiscation of travel documents non- adherence to conditions of work, inordinate profits to middle man. India is also a destination country for persons from Bangladesh and Nepal, and a bulk of those trafficked from these countries are women and children. In both cases the initial migration legal, illegal may be voluntary and subsequently migrants may be trafficked for sexual exploitation or any other factor. The numbers are very large, though precise figures are lacking and need to be tackled urgently. The 2010 Trafficking in persons Report  [16]  also points out that ninety percent of the trafficked persons belong to the most disadvantaged groups. It also carried evidence of NGO reports on duping of girls from north east India with Promises of jobs and then forcing them into prostitution as well as forced marriages. This heinous crime needs to be addressed urgently. There are legislations which deal with criminalizing a number of offences which are not specifically dealt with in the ITPA. These include penalizing acts such as procuring, buying and selling of human beings importing or exporting human beings, buying and selling minors, coercing or forcing marriage of minors, kidnapping and abducting and using force for the purpose of trafficking, slavery and slavery like conditions and unacceptable form of labor. Children (Pledging of Labour) Act,1933 4-6 Penalties for pledging labour of children(under 15 years) Bonded Labour System(Abolition )Act,1976 16 Compelling a person to render bonded labour or forced labour. Juvenile Justice Act,2000 2(vii) A child in need of care and protection includes one who is vulnerable and likely to be trafficked. 26 Procuring juveniles for hazardous employment. Trafficking and organised crime as defined by the law in India.- for the purpose of understanding cross border trafficking, especially in the context of organised crime, there are two definitions that need to be analysed, wiz, trafficking and organised crimes. How India defines and engages with these two terms is an indicator of the legal protection given to combat trafficking as an organised crime. Domestic Law of India There is no current central legislation in India with regard to organized crime. Some States however have legislated on the same. Maharashtra, which was the first State to have an Act,  [18]  defines organized crime as any continuing unlawful activity by an individual, singly or jointly, either as a member of an organized crime syndicate or on behalf of such syndicate, by use of violence or threat of violence or intimidation or coercion or other unlawful means, with the objective of gaining pecuniary benefits, or gaining undue economic or other advantage for himself or any other person, or promoting insurgency.  [19]   In the absence of a specific law on organized crime, reliance is placed on general provisions in criminal law dealing with common intention to commit an offence  [20]  , criminal conspiracy  [21]  and abetment. Anti-corruption laws may also be used. India has addressed trafficking both directly and indirectly in its Constitution. There are three Articles spread over Fundamental Rights in Part III and Directive Principles of State Policy in Part IV which address trafficking related issues. The chart below summarizes the provisions. Provisions on Trafficking in the Constitution of India  [22]   Article 23 Fundamental Right prohibiting trafficking in human beings and forms of forced labor. Article 39(e) Directive Principle of State Policy directed at ensuring that health and strength of individuals are not abused and that no one is forced by economic necessity to do work unsuited to their age or strength.. Article 39(f) Directive Principle of State Policy stating that childhood and youth should be protected against exploitation. India has a written Constitution, and though the above provisions make Indias mandate on trafficking clear, penalizing and tackling trafficking is dealt with by legislation. The Constitution specifically mentions trafficking in human beings as well as forced labor and also indicates the special protection to be provided to vulnerable groups in society. The Constitution of India discusses provisions on trafficking at two levels one, at the level of Fundamental Rights which are basic rights available to all, irrespective of caste, creed, sex, place of birth, etc., and two, at the level of Directive Principles of State Policy. Fundamental Rights are justiciable and can be directly enforced in a court of law, whereas Directive Principles of State Policy are non-justiciable and cannot be directly enforced in a Court of Law. However, Directive Principles play a major role in shaping the policy of the State and may sometimes be the basis that legislation is built on. As a Fundamental Right in Article 23, trafficking in human beings is prohibited as are all forms of forced labor. According to Directive Principles of State Policy in Articles 39(e) and (f), the health and strength of workers should not be abused. It prohibits exploitation of persons to perform work which is unsuitable for them. It also specifically protects children and you th against exploitation of any kind. While the provisions in the Directive Principles of State Policy do not mention trafficking, it mentions exploitation which is a key element in trafficking. 1.4 International legislation History of international legislation International pressure to address trafficking in women and children became a growing part of the social Reform movement in the United States and Europe during the late 19th century. International legislation against the trafficking of women and children began with the ratification of an international convention in 1901, followed by ratification of a second convention in 1904. These conventions were ratified by 34 countries. The first formal international research into the scope of the problem was funded by American philanthropist John D. Rockefeller, through the American Bureau of Social Hygiene  [23]  . In 1923, a committee from the bureau was tasked with investigating trafficking in 28 countries, interviewing approximately 5,000 informants and analyzing information over two years before issuing its final report. This was the first formal report on trafficking in women and children to be issued by an official body. The League of Nations, formed in 1919, took over as the international coordinator of legislation intended to end the trafficking of women and children. An international Conference on White Slave Traffic was held in 1921, attended by the 34 countries that ratified the 1901 and 1904 conventions. Another convention against trafficking was ratified by League members in 1922, and like the 1904 international convention, this one required ratifying countries to submit annual reports on their progress in tackling the problem. Compliance with this requirement was not complete, although it gradually improved: in 1924, approximately 34% of the member countries submitted reports as required, which rose to 46% in 1929, 52% in 1933, and 61% in 1934. 1921 International Convention for the Suppression of the Traffic in Women and Children (sponsored by the League of Nations) Convention for the Suppression of the Traffic in Persons and of the Exploitation of the Prostitution of Others (United Nations General Assembly resolution, came into force in 1951) Current international laws Convention on Consent to Marriage, Minimum Age for Marriage, and Registration of Marriages, entered into force in 1964 Protocol to Prevent, Suppress and Punish Trafficking in Persons, especially Women and Children; and Protocol against the Smuggling of Migrants by Land, Sea and Air. ILO Forced Labour Convention, 1930 (No. 29) ILO Abolition of Forced Labour Convention, 1957 (No. 105) ILO Minimum Age Convention, 1973 (No. 138) ILO Worst Forms of Child Labour Convention, 1999 (No. 182) CHAPTER-II :: LEGAL FRAMEWORK AND POLICIES 2.1 Definition of Trafficking Article 3 of the UN Protocol to Prevent, Suppress, and Punish Trafficking in Persons, especially Women and Children, supplementing the UN Convention Against Transnational Organized Crime, 2000, states: Trafficking in Persons shall mean the recruitment, transportation, transfer,harbouring or receipt of persons, by means of the threat or use of force or other forms of coercion, of abduction, of fraud, of deception, of the abuse of power or of a position of vulnerability or of the giving or receiving of payments or benefits to achieve the consent of a person having control over another person, for the purpose of exploitation. Exploitation shall include, at a minimum, the exploitation of the prostitution of others or other forms of sexual exploitation, forced labour or services, slavery or practices similar to slavery,servitude or the removal of organs.  [24]   Article 1 (3), SAARC Convention on Preventing and Combating Trafficking in Women and Children for Prostitution, signed by India on January 5, 2002, states: Trafficking means the moving, selling or buying of women and children for prostitution within and outside a country for monetary or other considerations with or without the consent of the of the person subjected to trafficking  [25]  . Article 1 (4) of the SAARC Convention defines Traffickers as: Traffickers means persons, agencies or institutions engaged in any form of trafficking. Article 34 of the Convention on the Rights of the Child (CRC) states: States Parties undertake to protect the Child from all forms of sexual exploitation and sexual abuse. For these purposes, States Parties shall in particular take all appropriate national, bilateral and multilateral measures to prevent: (a) The inducement or coercion of a child to engage in any lawful sexual activity; (b) The exploitative use of children in prostitution or other unlawful sexual practices; (c) The exploitative use of children in pornographic performances and materials. Further, Article 35 of the Convention on the Rights of the Child states: States Parties shall take all appropriate national, bilateral and multilateral measures to prevent the abduction of, the sale of or traffic in children for any purpose or in any form. The Immoral Traffic (Prevention) Act, 1956 (ITPA) does not specifically define trafficking. However, the ingredients of trafficking, such as sexual exploitation and abuse of persons; running of a brothel; living on the earnings of a prostitute; procuring, inducing or taking a person for the sake of prostitution; detaining a person for prostitution, etc., are contained in Sections 3, 4, 5, 6, and 8 of the Act. Merger Problems -- No Problem :: essays research papers

I have documented in the previous paper for this class my beef with the authors: that they have a ready-made set of excuses absolving workers of all of the blame for downward spirals in productivity - rather, it’s the cold sterility of computer technology, or mergers, or globalization, or cost-cutting, or reengineering, or outsourcing, or some combination of the above that is to blame for the unraveling of the corporate culture as we know it. In the words of Charlie Brown, â€Å"Good grief.† Perhaps it’s because I’ve never been a part of a strong, warm workplace culture, but I believe that the authors underestimate the value of just coming in, doing your job, and not worrying about having a social life or friends at work, and not carrying on about awful the employment landscape is today. Those things are all nice and might be life-affirming and lend "meaning" to a person's life, but doing the job is paramount to all of the above. (It's not polit ically correct to point this out.) Again, I want to reiterate a point I made in the previous paper: a job is a privilege, not a right. There is no more â€Å"right† to a job than there is a â€Å"right† to win the lottery. I am a terribly lucky, blessed person to have the job that I have, and I work for someone who has the reputation of being an absolute monster at times. But we have gotten so carried away with assigning rights we have no business assigning, rights that the recipients have no business having ascribed to them, that we forget that responsibilities are also involved. The concept of "rights without responsibilities" leads to anarchy, and virtual anarchy is the condition found in many factories and other places of employment today. And the fact that so many people have conspired to legitimize the crap put forth by the two authors - from the publishers to the universities that assign â€Å"The New Corporate Cultures† as a text - makes me wonder if the world has not lost its co llective head. That said, the authors do make some good points about Merger Mania (the topic of Chapter 5) and its effect on organizational cultures, but they don’t offer solutions to the problems; rather, they tend to harp on the fact that the sacred employee is harmed in some way by the merger/ acquisition process.
